1. Introduction

TrackHead is a comprehensive platform designed to enable users to track crypto wallets across multiple EVM chains and Solana. Our platform provides various tools for monitoring wallet activities, on-chain analysis, and on-chain trading tools based on blockchain and third-party information. It is important to note that TrackHead is solely a tracking platform and not an investment advisory service. We do not offer any form of investment advice.

1.1. BETA: TrackHead is currently in an open beta phase, which means errors, downtime, and other issues can occur at any time. While we strive to maintain 100% uptime, we cannot guarantee it. Users should note data themselves as TrackHead services can be discontinued or changed at any time with or without notice.

1.2. Newsletter: Additionally, users agree to receive email notifications with product updates and important information regarding our services. If users wish to opt-out, they can do so through their account settings.

1.3. Domain: Please note that TrackHead operates solely on the .app domain, and users should be cautious of any other domains claiming to represent TrackHead.

2. Acceptance of Terms

By registering on TrackHead and/or using the site, you agree to these terms of service, our disclaimer statement, and privacy policy. If you do not agree with these terms, please do not use the site. Your use of this site signifies your continuing consent to our Disclaimer Statement and Privacy Policy (including our cookie policy), which you can examine any time by clicking on the “Disclaimer” and “Privacy” links on the site. Information that you supply to us (if any), and any information about your use of the site that we obtain, will be subject to our Privacy Policy.

3. User Responsibilities

3.1. Due Diligence: Users must perform their own due diligence. TrackHead provides tools and information to assist in tracking and analysis, but users are ultimately responsible for verifying the accuracy and completeness of the data they use.

3.2. Accuracy: Users are responsible for ensuring the accuracy and completeness of the wallets they track. TrackHead is not liable for any discrepancies or errors in the tracked information.

3.3. Compliance: Users must comply with all applicable laws and regulations when using TrackHead. Any illegal activities or misuse of the platform are strictly prohibited.

4. Account Registration

4.1. Creation Process: To access certain features of TrackHead, such as the 'FEED' and 'WALLETS', users must register and be logged in. During registration, users will need to provide valid login details, including an email address.

4.2. Wallet Limitations: Registered users can add up to 5 wallets for free. This limitation ensures fair use of the platform's resources.

5. Pro Plan

5.1. Features: The Pro plan provides users with the ability to track more wallets and access additional features and advanced analytical tools. These features are designed to offer enhanced tracking and analysis capabilities for professional users.

5.2. Subscription Terms: The Pro plan is billed monthly at a rate of $34.99, charged via the Stripe payment provider. Subscriptions can be cancelled at any time, with cancellation taking effect at the end of the current billing period. Users will continue to have access to Pro features until the end of the current billing period following cancellation. No refunds will be issued for partial months.

5.3. Payment Method: All payments for the Pro plan must be made through Stripe. Users must provide valid payment information and ensure that their payment details are up to date.

5.4. Renewal: The Pro plan subscription will automatically renew each month unless cancelled by the user. Users will receive a notification of the upcoming renewal and the option to cancel before the renewal date.

5.5. Changes to Subscription: TrackHead reserves the right to modify the pricing and features of the Pro plan. Users will be notified of any changes in advance, and changes will apply to subsequent billing periods.

6. Purchasing Data Packages

TrackHead offers both free and paid data packages that provide users with detailed wallet information and other valuable insights. These packages are designed to cater to different levels of user needs, from starter packages to more comprehensive data sets.

6.1. Free Packages: Users can access starter packages at no cost, which include basic data and insights to help them get started with tracking and analysis.

6.2. Paid Packages: In addition to free packages, TrackHead offers paid packages that provide more detailed and extensive data. Once a paid package is purchased, it cannot be refunded as the data is immediately accessible and can be stored by the user.

6.3. Dynamic Pricing: The pricing for paid packages is dynamic and may increase as more users purchase the package. This model ensures that the value of the data remains high and access is limited to prevent overcrowding and data saturation.

7. Data Accuracy and Limitations

TrackHead strives for a 100% uptime of tracking to ensure that all swaps are monitored, but it is important to note that we are only tracking swaps and no other types of transactions. Data fetched from the blockchain and third parties may not always be accurate. Due to the nature of the blockchain, we have to manually add the decentralized exchanges (DEXs) we monitor, which means some swaps may not be tracked if the DEX is not included in our monitoring list.

7.1. User Notification: If users notice that certain swaps are not being tracked, we appreciate a quick note so that we can add the relevant DEX to our monitoring list.

7.2. No Liability: TrackHead is not liable for any incorrect data or any actions taken by users based on the data viewed on TrackHead or any mentioned pages. Users should independently verify all data.

7.3. Disclaimer of Warranties: TrackHead disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, TrackHead limits liability for any damages arising from the use or inability to use the service.

8. External Links

TrackHead may include links to third-party sites like dexscreener. We are not responsible for the content or accuracy of external sites. Users should use third-party sites at their own risk.

9. Payment and Refund Policy

9.1. Payment Methods: Accepted payment methods will be listed on the site. Currently, payments are processed via Stripe.

9.2. Refunds: Paid packages and subscriptions are non-refundable once purchased, as the data is immediately accessible and can be stored by the user. For subscriptions, users can cancel at any time, with the cancellation taking effect at the end of the current billing period. No refunds will be issued for partial months.

10. User Conduct

10.1 Prohibited Activities: Users must not engage in illegal activities, misuse the platform, violate intellectual property rights, or engage in abusive behavior. Specifically, users agree not to:

  • Use the site in any way that breaches any applicable local, national, federal, or international law or regulation.
  • Copy, use, disclose, or distribute any information obtained from the site without our consent.
  • Violate the intellectual property rights of others, including copyrights, patents, trademarks, trade secrets, or other proprietary rights.
  • Post inaccurate, defamatory, obscene, shocking, hateful, threatening, or otherwise inappropriate content.
  • Harass, abuse, or harm another person.
  • Send or post unsolicited or unauthorized advertising, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any form of solicitation unauthorized by us.
  • Disclose information that you do not have the consent to disclose.
  • Post anything that contains software viruses, worms, or any other harmful code.
  • Use software, devices, scripts, robots, or any other means or processes to scrape the site or otherwise copy data from the site.
  • Bypass or circumvent any access controls or site use limits.
  • Reverse engineer, decompile, disassemble, decipher, or otherwise attempt to derive the source code for the site or any related technology.
  • Monitor the site’s availability, performance, or functionality for any competitive purpose.
  • Engage in “framing,” “mirroring,” or otherwise simulating the appearance or function of the site.
  • Access the site except through the interfaces expressly provided by us.
  • Override any security feature of the site.
  • Use the site in any manner not permitted by these Terms.
  • Interfere with the operation of, or place an unreasonable load on, the site (e.g., spam, denial of service attack, viruses).

10.2 Consequences: Violations of the terms of service may result in account termination without notice and potential legal action.

10.3 Termination of Service: TrackHead reserves the right to terminate or suspend user accounts at its sole discretion for any reason, including breach of terms. In the event of termination, users will be notified via email. Upon termination, users will lose access to their account and all associated data. TrackHead is not liable for any loss of data or other consequences resulting from account termination. Users may appeal the termination by contacting support within 30 days.

11. Intellectual Property

11.1. Ownership: TrackHead owns the content and intellectual property on the site. Users may not reproduce, reprint, publish, or otherwise exploit our content or technology without our express prior written consent.

11.2. User-Generated Content: Guidelines for user-generated content will be provided, if applicable. Users are responsible for ensuring that any content they generate complies with these guidelines and applicable laws.

13. Disclaimers and Limitation of Liability

16.1. Applicable Law: These terms are governed by and construed in accordance with the laws of Germany, without regard to its conflict of law principles.

16.2. Dispute Resolution: Any disputes arising out of or in connection with these terms shall be resolved by the courts of Germany. By using the site, users agree to submit to the jurisdiction of these courts for the resolution of any disputes.
